Friday, the high court of Punjab and Haryana rejected a criminal request filed by Kangana Ranaut, returned by the actor, thus allowed a defamation case against it to proceed to the trial. Ranaut had asked for the dismissal of both the underlying complaint and the invocation order made by a Bathinda court under articles 499 and 500 of the Indian Criminal Code.

The legal action stems from a retweet shared by Ranaut during the demonstrations of farmers 2020-2012. In her article, she wrote: “Ha ha ha, she is the same Dadi who presented in Time Magazine to be the most powerful Indian…. And it is available in 100 rupees. The Pakistani jurno diverted international public relations for India in an embarrassing way. We need our own people to speak for us internationally. ”

During the hearing under article 482 of the Code of Criminal Procedure, the tribhuvan Dahiya justice bench carefully analyzed the evidence and the arguments. The court said: “There are specific allegations against the petitioner, which is a celebrity, that false and defamatory imputations in it in retweet have designed the reputation of the respondent and the lowering in its own estimate, as well as in the eyes of others.

Judge Dahiya also noted: “The order was adopted after applying the mind to the facts of the case, examining the preliminary evidence in the light of the relevant provisions of the law.”

The observers stressed that the defense of Ranaut depended on the argument according to which the retweet lacked maliciousness and was shared in good faith – without awareness of any factual inaccuracy. However, the high court rejected this logic, rejecting that it was automatically protected by the ninth or tenth exceptions in article 499 IPC, which concerns the declarations made in good faith for the public good or warning the others.

Significantly, the court also stressed that Ranaut had had no excuse or recognition of the error after being informed that the person in the image was wrongly identified – and not the “Shaheen Bano” or the figure of the “Time magazine” as indicated.

The Magistrate of Bathinda previously issued an assignment on February 22, 2022, after preliminary evidence satisfied him that a case of prima facie defamation existed. The High Court affirmed this decision, noting that the magistrate “duly applied the spirit to recorded material” before the publication of the process.
