The actor of Bollywood, Saif Ali Khan, and his family underwent an important legal setback after the high court of Madhya Pradesh canceled a 25 -year -old order which confirmed their claim of ancestral goods of an estimated value of 15,000 overtones of rupees. The court has now ordered a new trial in the heritage dispute of several decades involving the former royal family of Bhopal.

Madhya Pradesh HC orders a new trial in the inheritance dispute of Rs 15,000 crores of Saif Ali Khan

The property in question dates back to the princely state of Bhopal and was inherited by Saif Ali Khan, his mother Sharmila Tagore, and his sisters Soha and Saba Ali Khan, after the death of Mansoor Ali Khan Pataudi, of the former Indian Cicket Captain and Nawab of Pataudi.

The court sets aside Decree 2000

A Bhopal district court held in 2000 that the Pataudi family was the legitimate heirs of the succession, on the basis of the succession of the Saif grandmother, Sajida Sultan, the daughter of the last decision of Nawab de Bhopal, Hamidullah Khan. However, in a new development, judge Sanjay Dwivedi of the high court of Madhya Pradesh canceled the decision of the court of first instance, invoking dependence on a precedent that the Supreme Court has since rejected.

“I am of the opinion that the court of first instance, without considering other aspects of the case, had rejected the proceedings, which relying too much on the judgment which has already been canceled by the Supreme Court,” said judge Dwivedi in the order. “Thus, in my opinion, the contested judgment and decree deserve to be and are put aside.”

The High Court ordered the Court of First Instance to re -examine the case from zero and allowed all parties to present new evidence in the light of recent legal developments. The new trial must be carried out quickly, ideally within one year.

Dispute context

The legal battle follows from the inheritance of the personal property of Nawab Hamidullah Khan, the last Nawab in power of Bhopal, who had three daughters: Abida, Sajida and Rabia. Sajida Sultan, who married Iftikhar Ali Khan Pataudi, was declared heir to the succession after his sister Abida emigrated to Pakistan. The succession was formalized in 1962 when the government of India issued a certificate appointing SAJIDA as the only heir.

Sajida’s son Mansoor Ali Khan Pataudi, inherited from the property, which was finally transmitted to Saif, Soha and Saba. However, other heirs of the Nawab – including Begum Suraiya Rashid and Nawab Mehr Tajida Sultan – challenged the inheritance, arguing that the partition of the property of Nawab Hamidullah was unfair and did not comply with Muslim personal law.

Their trial, initially rejected in 2000, was now relaunched by the High Court.

The order also referred to the membership instrument of 1949 through which the princely state of Bhopal merged with the Union of India. According to the agreement, NAWAB has retained the rights of personal properties, and the succession was to follow the succession of Bhopal to the law of 1947 on the throne.
