EXCLUSIVE: Bombay High Court restrains OTT release of Bhool Chuk Maaf; upholds PVR Inox’s rights; next hearing on June 16 (COMPLETE DETAILS INSIDE) : Bollywood News

In an important provisional decision, the High Court of Bombay on May 9, 2025, granted an AD-In-In-Inmo repair to PVR Inox Limited, retaining the films of Maddock and its associates of the publication of the film Bhool chuk maaf On any platform, including OTT – until the expiration of a maintenance period of 8 weeks after its first theatrical version in India. The verdict came after the PVR Inox moved the court urgently, following the sudden revocation of Maddock films from their agreement just one day before the theatrical release scheduled for the film on May 9.

The basic dispute occurred when Maddock Films, quoting concerns about increased national security, canceled the theatrical launch and opted for a direct version of OTT on May 16 via a platform belonging to one of the defendants (Amazon Prime Video). However, PVR Inox argued that it was a clear violation of their binding agreement signed on May 6, 2025, which not only mandated a theatrical version but also an exclusive window of 8 weeks before any first digital.
Maddock Films argued that the clause demanding an 8-week theatrical restraint was only applied if the film had released in the cinemas (which they chose not to do due to increased national security problems), said they had the right to choose the liberation platform as relaxation of copyright and argued that PVR stainless steel, after having opted for the damage.
One of the central concerns raised by the PVR Inox Council, Mr. Dinyar Madon, was that the 31 PVR theaters in New Delhi – where the film was to be published – was fully operational, had started weeks of promotional activity and also recorded significant advanced reservations. This directly contained Maddock’s complaint that increased security problems required change. The court noted that Maddock had produced no official government circular or a notification supporting the decision, and said that the only closure of the cited cinema – one in Jodhpur – was not relevant because the film was never planned which is released.
The doctor of judge Arif pointed out that the decision to abolish theatrical release was caused by commercial calculations. The producers had apparently concluded that a direct-ott strategy was more beneficial in current circumstances. However, the court firmly judged that it was not a valid base to move away from a binding agreement. The judge observed that the simple drawback or the change of economic perspectives does not grant a part of the freedom to renounce contractual obligations – in particular in the absence of a clause of force majeure, which the agreement in question did not contain.
Unlike the inaction of Maddock Films, PVR Inox had completed its part of the negotiation – blocking the screens through India, promoting the film via social networks, the lands in the theater and the video walls and the launch of public ticket sales according to the agreed release date. The judge noted that a last minute cancellation of this magnitude would financially harm the multiplex operator, but could also harm his reputation and his consumer confidence.
In addition, the court rejected the defense that PVR had lost its right to an injunction by demanding damages. He judged that by virtue of article 42 of the law on specific repairs, an applicant may still request an injunctive compensation despite his request for compensation in parallel. The court also denied the argument of the copyright holder according to which the property allowed them to unilaterally choose the liberation platform, declaring that it could not replace a contractual agreement concluded.
The case is now listed for a new hearing on June 16, 2025. Until then, Bhool chuk maaf cannot be published on OTT or any other non-theatrical platform in India.
