Bombay HC quashes non-bailable warrant against Arjun Rampal in tax evasion case, calls lower court order “mechanical and cryptic” : Bollywood News

The High Court of Bombay has canceled a non -reproducable mandate issued against the actor Arjun Rampal by a magistrate court in a tax case in 2019. The High Court qualified the previous order as “mechanical”, “crypt” and “contrary to the law”, declaring that it had been adopted without appropriate application of the spirit.

A courtyard of the justice holidays admitted Sethna rendered the decision on May 16 after Rampal challenged the order of April 9 which guided the issuance of a non -reproducable mandate. The case stems from a complaint of 2019 filed by the Department of income tax under article 276c (2) of the income tax law, which concerns the non-payment of tax.
According to Rampal’s petition, his lawyer had submitted a request requesting a personal appearance exemption from the magistrate. Despite this, the magistrate rejected the request and issued the mandate. The high court observed that the offense involved was renamed, with a maximum punishment of three years, and therefore did not justify such a severe order.
Judge Sethna pointed out: “It is a cryptic order that lacks the application of the mind.” The court also pointed out that the magistrate had not recorded reasons before publishing the mandate and ignored the fact that Rampal’s lawyer was present in the court on his behalf.
The High Court also stressed that the issuance of a non -reproducable mandate in such a case could unfair harm the actor’s reputation and the legal position. He noted that the actions of the lower court have neglected key legal considerations and were not in accordance with the established procedures.
Rampal lawyer, Advocate Swapnil Ambure, argued that the opinion of December 2019 and the mandate of April 2025 were arbitrary and baseless. He said that the total amount of tax for the 2016-2017 financial year, which is at the center of the complaint, had been paid, although after a certain delay. “There is no tax evasion, as the ministry claims,” said Ambure to the High Court.
The case will now be resumed on June 16 for a new hearing, while the court continues to examine other aspects of the case.
